Documenting Your Personal Injury Claim

When you are injured in an automobile collision, the amount of paperwork involved can feel overwhelming: a frequently asked question is what documentation is important to keep and give to my Colorado Springs Injury Attorney and what can be disregarded.  The general rule is, if a document is in any way related to the collision and/or your injury/treatment, KEEP IT. 

  1. Medical Records & Bills: Start by keeping a list of all medical providers you have seen since the crash and note on which date you saw those providers.  Once your treatment has concluded with a particular provider, let your attorney know.  Because insurance companies rely so heavily on medical records to assess the extent of your injuries, it is important that you are thorough and accurate in reporting ALL of your symptoms and medical issues to your treating physicians.
  2. Discharge Instructions & Doctor’s Notes: Discharge Instructions are NOT the same thing as medical records, but are still important for your case and for your recovery.  Keep them as well as copies of any doctor’s orders, such as referrals or orders to miss work.  
  3. Medical Mileage:  Note the start and end destination for each of your medical appointments so that you can calculate medical miles driven.  Though the 2016 medical mileage rate is only $0.19/mile, mileage expenses can add up to hundreds, and sometimes thousands, of dollars when an injury victim is required to attend hundreds of appointments throughout the course of her recovery.
  4. Receipts: If you say to yourself “I would not have incurred this expense had I not been injured,” keep the receipt.  This applies to over the counter and prescription medications, medical equipment/supplies, and the like.  If in doubt, keep the receipt. 
  5. Police Reports: Keep copies of anything you were given at the scene by Police and get a copy of the police report or provide the report number and department name to your attorney so that s/he can order the report.
  6. Property Damage Photos & Estimates:  Keep all photographs taken of the vehicles involved and damage estimates written (whether by a body shop or an insurance company) even AFTER your property damage claim is resolved as these may later be relevant to your injury claim.
  7. Declarations Pages & Policy Contracts:  Make a list of ALL insurance in force on the date of the collision.  This includes all policies of insurance in your household (be they health, disability, auto, or otherwise) as well as the auto insurance information of the at fault driver and at fault vehicle owner.  Do not assume that the only relevant policies of insurance are the auto policies for the vehicles involved in the crash.  Your attorney will determine which policies are relevant for your particular circumstances.  
  8. Timesheets, Paystubs, & Tax Returns:  Some or all of these documents may be necessary to support a claim for lost wages, depending on your employment type.  Start gathering and keeping track of these documents now so that it is not an onerous task later.  If you are self-employed, keep any other documentation regarding lost income.
